Trekoholics – Terms & Conditions of Service & Participation Agreement

This Participation Agreement ("Agreement") is made between Trekoholics (hereinafter referred to as "Trekoholics"), having its registered office at [Insert Registered Address], and the individual or group booking a trek, expedition, or adventure program (hereinafter referred to as the "Participant").

By confirming a booking with Trekoholics, the Participant acknowledges that they have read, understood, and accepted the following terms and conditions. This document establishes a legally binding contract between Trekoholics and the Participant.

1. Assumption of Risk & Participant Responsibility
  • Trekking, mountaineering, and adventure travel involve inherent risks such as high-altitude sickness, accidents, injuries, illness, adverse weather, wildlife encounters, and unforeseen natural conditions.
  • Participation is voluntary, and the Participant accepts full responsibility for their health, safety, fitness level, and preparation.
  • All relevant medical or physical conditions must be disclosed prior to booking.
  • Trekoholics will take all reasonable safety precautions but cannot provide an absolute guarantee of a risk-free environment.
2. Bookings & Payments
  • Booking a trek automatically implies full acceptance of these Terms & Conditions.
  • The Participant must verify trip details (dates, itinerary, and documentation) at the time of booking.
  • Payments must be completed as per the communicated schedule. Delayed or incomplete payments may result in cancellation without refund.
  • Refunds, where applicable, will be processed within 15–30 business days.
  • Only the portion of payment made in cash is refundable in cash. Payments made through vouchers, offers, promotional codes, or non-cash methods will not be refunded in cash.

Voucher Policy:

  • Non-transferable and non-exchangeable.
  • Cannot be clubbed with other offers.
  • Applicable only on treks directly organized by Trekoholics within India.
  • Valid exclusively for bookings made using the registered participant's email or phone number.
3. Participation of Minors
  • Participants under 15 years must be accompanied by a parent/guardian and a signed consent form.
  • Participants between 15–18 years may join independently with written parental consent.
4. Marketing & Media Content

Photos, videos, and promotional materials shared by Trekoholics are only illustrative and not part of any guaranteed service.

5. Documentation & Permits

All mandatory documents, ID proofs, and permits must be submitted prior to departure. Trekoholics will not be held responsible for trip cancellations or delays due to incomplete/missing paperwork.

6. Official Communication

All official updates and communication will be sent to the registered email address provided at the time of booking.

7. Insurance
  • Participants are strongly encouraged to purchase personal travel insurance covering high-altitude trekking, illness, emergency evacuation, trip delays, and cancellations.
  • If the Participant does not purchase their own insurance, Trekoholics will arrange standard third-party insurance (Indian citizens only).
  • Trekoholics holds no liability for disputes or claims arising between the Participant and the insurer.
8. Conditions of Travel

Remote and high-altitude regions may have limited facilities. Discomfort arising from terrain, weather, or restricted amenities will not be considered the responsibility of Trekoholics.

9. Exclusions from Trip Price

Unless specified in writing, the trip fee does not include:

  • Airfare, visas, insurance, medical evacuation, excess baggage, tips, alcoholic beverages, laundry, or other personal expenses.
10. Luggage & Personal Property

The Participant is solely responsible for their belongings. Trekoholics will not be held liable for loss, damage, or theft of personal items.

11. Optional & Extra Activities

Any additional activities not part of the official itinerary are undertaken at the Participant's own risk and expense.

12. Force Majeure

Trekoholics will not be responsible for cancellations, delays, or modifications caused by events beyond its control, including but not limited to natural disasters, strikes, pandemics, political unrest, or government restrictions.

13. Itinerary Adjustments

Trekoholics reserves the right to modify, shorten, or cancel any itinerary due to safety, weather, or operational reasons. Any additional expenses resulting from such changes will be borne by the Participant.

14. Cancellations & Refund Policy
  • No refund or voucher will be issued if the Participant withdraws voluntarily or is removed due to violation of rules.

If Trekoholics cancels a trip before commencement:

  • An alternate trip or new date will be offered.
  • A credit voucher (valid for 12 months) may be issued.
  • Transfer to another trek may be arranged (cost differences payable).
  • If a trip is abandoned after commencement, no refund will be provided.
  • Trekoholics is not responsible for indirect travel costs such as flight tickets or visa charges.
15. Grounds for Discontinuation

A Participant may be removed from the trek if:

  • They suffer from severe altitude sickness or a critical medical condition.
  • They are unable to maintain minimum group pace.
  • They are found consuming alcohol, drugs, or engaging in unsafe, offensive, or unlawful behavior.

No refund or voucher will be issued in such cases.

16. Medical Emergencies & Evacuation

Any medical treatment, evacuation, or related expenses incurred during the trip are the sole responsibility of the Participant.

17. Third-Party Services

Certain services, such as guides, porters, and transport, may be outsourced to third-party vendors. Trekoholics is not liable for the performance or conduct of these providers.

18. Photography & Media Rights

By participating in a trek, the Participant grants Trekoholics the right to use photos, videos, or other media captured during the trip for promotional purposes, unless explicitly opted out in writing before departure.

19. Website & Content

Information on the Trekoholics website is subject to updates without prior notice. Unauthorized reproduction or misuse of website material is prohibited.

20. Collaboration Policy

All partnerships, influencer tie-ups, and collaborations require prior written approval from Trekoholics. The company reserves the right to decline proposals without explanation.

21. Blacklisting Policy

Trekoholics may permanently blacklist any individual for misconduct, violation of safety protocols, harassment, or defamation of the brand. No refunds will be issued in such cases.

22. Complaints & Dispute Resolution

All complaints must be submitted in writing within 7 days of trip completion. Disputes, if any, will be resolved under arbitration in Dehradun, Uttarakhand, governed by Indian law.

23. Governing Law

This Agreement shall be governed exclusively by the laws of India, with courts in Dehradun, Uttarakhand holding sole jurisdiction.
